Agreement overview
This Service Agreement (“Agreement”) constitutes the complete Terms of Service between you (“Customer”, “Client”, “You”) and SERVERBIKE LTD (“Provider”, “We”, “Us”, “ServerBike”). By using any ServerBike service, you agree to be bound by these terms. ServerBike reserves the right to modify this Agreement at any time; continued use of services after modification constitutes acceptance.
This Agreement should be read together with the SLA, Privacy Policy and Refund Policy. Service-specific commercial details should be reviewed in the customer’s order, billing record or related service documentation where applicable.
Parties, acceptance and scope
This Agreement governs the use of ServerBike services and related products offered by ServerBike LTD.
- “Services” — web hosting, VPS, dedicated servers, colocation and related products offered by ServerBike LTD
- “Customer Content” — all data, files, applications and material stored or transmitted through the Services
Customer responsibilities and acceptable use
You agree that Customer Content and use of Services will not:
- Violate any applicable law or regulation
- Infringe upon intellectual property rights of any third party
- Contain or distribute malware, viruses or malicious code
- Be defamatory, discriminatory or unlawful
- Be used primarily for archival or file-sharing storage unrelated to web hosting
The following are strictly prohibited:
- Child exploitation material
- Copyright infringement and warez distribution
- IRC bots or unauthorized automated services
- Spam, unsolicited bulk email or phishing
- Unauthorized reselling of services
For shared and reseller hosting, “Unlimited” resources are provided for normal use by personal and small business websites. Services must not be used for file sharing, archival storage or purposes unrelated to web hosting. If resource usage exceeds 25% of server CPU for more than 90 seconds and affects other customers, the account may be suspended and an upgrade recommendation issued.
Account security, software and backups
You are responsible for keeping all scripts, applications and software updated and secure. If your account is compromised, it may be suspended to protect the network.
Backups are your responsibility. ServerBike LTD is not liable for any data loss. You should maintain independent backups of all data stored on the Services.
Billing, renewal, suspension and cancellation
- Payment is required in advance before service activation
- Invoices are issued 10 days before the renewal date
- Services auto-renew unless cancelled at least 15 days before the renewal date
- Promotional or coupon pricing applies to the initial term only
- Cancellation requests must be submitted through the Client Area
- Back up all data before requesting cancellation — data is permanently deleted upon termination
Dedicated servers are not refundable. VPS services may be eligible for refund only when a technical problem cannot be resolved by ServerBike and the refund request is submitted within the first 48 hours after service delivery. Full details are available in the Cancellation and Refund Policy.
Service-specific terms
The Services include web hosting, VPS, dedicated servers, colocation and related products. Where a specific operational policy applies to a service type or location, that policy forms part of the applicable service terms.
Turkey location — fair usage policy
Shared network ports (1 Gbps / 10 Gbps) at Turkey locations are subject to a Fair Usage Policy. Continuous full-port saturation is not permitted. The fair-use transfer allowance is 100 TB per month. After 100 TB of monthly transfer, the port may be limited to 100 Mbps. Customers requiring guaranteed bandwidth must upgrade to a dedicated unmetered port at additional cost.
ServerBike targets 99.89% network uptime. This excludes scheduled maintenance, issues caused by the customer, including DDoS attacks targeting the customer’s services, third-party failures outside ServerBike’s control and violations of this Agreement. Disclaimer of warranties, limitation of liability and indemnification
Services are provided “as is” and “as available.” ServerBike LTD makes no warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose or non-infringement. ServerBike does not guarantee that services will be uninterrupted, error-free or completely secure.
ServerBike LTD shall not be liable for any direct, indirect, incidental, special or consequential damages arising from use of, or inability to use, the Services.
You agree to indemnify and hold harmless ServerBike LTD, its officers, directors, employees and agents from any claims, damages, losses or expenses arising from your use of the Services or violation of this Agreement.
